Because Michael never actually turned State's evidence. Michael's deal with Norton was unofficial and completely under the table. Michael agreed to tip off Norton to the escape plan, allowing Norton to take down either Brad or Trevor, and fake Michael's death. Michael Townley is officially dead, but Brad was buried in his place.

In turn, Norton agreed to give Michael and his family an alias, making them the DeSantas, and allowed Michael to access his $50 million in savings to sustain themselves. Michael just has to pay Norton somewhere between $10k and $99k every month to keep his cover.

So, Michael isn't in witness protection because the government (outside of Norton) doesn't know Michael is actually alive. The deal was never to turn over Lester and any survivors. The deal was to quietly get out and completely start over.
